A New Jersey police officer can pull you over for a DUI in one of two ways:
1. Stop Based on a Motor Vehicle Violation
If the police pull you over for a routine traffic violation, they may subsequently arrest you for drunk driving. However, the key to a valid DUI arrest is the presence of a reasonable basis for the initial stop. A reasonable basis, like probable cause, allows an officer to stop a driver for a traffic violation and subsequently investigate for a DUI.
Our New Jersey DUI lawyers are quick to note that race, age, or gender profiling is not a legal reason to pull over driver and later arrest him or her for a DUI. Such DUI evidence will be inadmissible at trial on account of the illegal traffic stop and may ultimately result in the dismissal of the DUI charges.
2. Stop Based on a Sobriety Checkpoint
Another way for the police to arrest you for a DUI is based on a sobriety checkpoint stop. These checkpoints are subject to the same Constitutional standards as other types of vehicle stops conducted by police officers.
