Even one DUI conviction can be damaging to your driving record, your reputation, and your career opportunities. However, having multiple DUI convictions is a very serious matter with potentially life-altering consequences.
Rationale Behind Multiple DUI Conviction Penalties
Most jurisdictions have increased the penalties for multiple DUI convictions, hoping to deter repeat offenders. Since many people convicted of DUI offenses suffer from alcoholism and other addictions, repeat offenses are all too common. States have an interest in encouraging those who have driven under the influence to seek help for any addictions they may have, and to avoid making the same mistake twice.
As a result, many jurisdictions have created special categories for multiple DUI offenses. In New Jersey, each subsequent DUI charge carries harsher penalties and fines.
First Offense
A DUI in New Jersey is defined as operating a motor vehicle or boat with a blood alcohol content (BAC) of .08% or greater. For a first offense, a DUI in New Jersey carries the following consequences:
- A license loss of between 7 months and one year;
- A fine of up to $500;
- A prison term of up to 30 days;
- Attendance at up to 48 hours of an intoxicated driver education program; and
- If BAC was .15% or greater, an ignition interlock device requirement during license loss and for up to a year following the restoration of your license.
For BAC between .08% and .10%, the fine is capped at $400 and the license loss at 3 months.
Second Offense
A second DUI offense within 10 years of the first carries:
- A fine of up to $1000;
- A license suspension of 2 years;
- A prison term of between 48 hours and 90 days –
- 30 days of community service
- 48 hours of intoxicated driver education program
- An ignition interlock device during license suspension and 1-3 years following restoration.
Third Offense
A third DUI offense within 10 years of the second offense carries:
- A $1000 fine
- A license loss of 10 years
- A 180-day prison term
- Up to 90 days of community service
- Up to 48 hours of intoxicated driver education program
- An ignition interlock device during license suspension and 1-3 years following restoration.
Surcharges
In addition to the other penalties, each of these offenses carries surcharge fines that are allotted to various drunk driving prevention funds. Surcharges are $1000 for three years for the first two DWI offenses and $1500 for three years for third offense.
