What Is “Implied Consent” Under New Jersey DWI Law?

Although you are legally obligated to submit to a blood or alcohol test, you can refuse to do it. However, a refusal can have serious consequences. More importantly, a refusal to submit an alcohol or blood test will also require you to appear before a judge to determine whether you were drunk at the time of the arrest.

If it is determined that you were indeed intoxicated when the officer pulled you over and your BAC was greater than 0.08%, your driving privileges can be revoked for a minimum of 3 months if it was your offense. If you had a prior DWI conviction, your license can be revoked for up to 10 years.
