What Is a Bench Trial in New Jersey?

Bench trial AttorneyIf someone were to ask you to describe what a trial look likes, what would you say? If you’re like most people, you would picture a courtroom with a judge and jury. More often than not, this image is accurate. However, in some legal situations, the jury is absent, with only a judge left to determine the outcome. This is known as a bench trial. If your case involves a bench trial, you should consult with a New Jersey traffic ticket attorney who can better explain the relevant court procedures

When Are Bench Trials Appropriate?

The Sixth Amendment of the United States Constitution grants every citizen the right to a trial by jury if he or she is accused of a crime. However, although jury trials are the standard in the majority of criminal cases, in some situations, the accused may only receive a bench trial. In New Jersey, bench trials are generally reserved for traffic cases, disorderly person offenses and DUI cases.

If your particular legal situation only grants you the right to a bench trial before a municipal court judge, your New Jersey traffic ticket attorney will help you prepare by first educating you about your legal rights under the law.

Legal Requirements of Bench Trials

The same legal requirements apply for both bench and jury trials. In order to convict the defendant on the accused charges, the prosecution must prove that you are guilty of the offense in question beyond a reasonable doubt. The final verdict, however, is left entirely up to the judge. In other words, there is no jury deliberation with regard to the outcome of your case.
