A Primer in NJ Traffic Points, Surcharges and License Suspension
As a New Jersey driver, it is important to understand the significance of traffic points. Most people recognize that it is a bad thing to allow points to accumulate against their licenses. What about surcharges? How many points does it take to incur license suspension?
Traffic Points
The State of New Jersey’s Motor Vehicle Commission (“MVC”) is the governing agency that assesses points for traffic violations. In New Jersey, points are only mandated for moving violations. Essentially, you could amass a collection of parking tickets, and never receive a traffic point. (Of course, we are not suggesting you risk associated additional costs or even warrants for your arrest for neglecting to pay parking tickets.)
There are a few important reasons to limit traffic points. One is to avoid the cost associated with the fines and prospective insurance surcharges/rate increases. Another is to hold on to the privilege of maintaining a driver’s license. In brief, the MVC outlines what an accumulation of points can do:
• Surcharges are assessed to drivers who accumulate six points within three years of their current driving record
• An accrual of twelve points calls for license suspension
• Insurance companies can mandate rate increases with even the first moving violation
Surcharges
Anytime traffic points are assessed, the State reserves the right to issue a surcharge. In many instances, the surcharge must be paid for three consecutive years. This would be an additional cost to the one associated with the accrual of six points during a three year period.
Points for Common Violations
With the exception of traffic violations on the Garden State Parkway, New Jersey Turnpike and Atlantic City Expressway, most traffic violations and their point allocations are found in Title 39 of the New Jersey Statutes. Here is a sampling of the points assessed to some common violations:
• Failure to observe traffic signals 2
• Tailgating 5
• Reckless driving 5
• Careless driving 2
• Exceeding maximum speed 15-29 mph over limit 4
