Governor Christie Signs Into Law the Provisions of Conditional Dismissal Program for New Jersey Municipal Courts

On September 9, 2013, New Jersey Governor Christie signed into law the provisions of bill A-3598/S-2588. This program creates a “conditional dismissal” program for certain individuals who are charged with disorderly and petty disorderly persons offenses in New Jersey municipal courts.

The main goal of this program is to allow certain first time offenders facing criminal sanctions in the state to avoid conviction and expunge their records quicker. Qualifying first time offenders will need to enter conditional pleas of guilty and will be placed on probation. If they successfully complete the terms of their probation, pay a fine of $75, and have committed no new offenses, they will receive a dismissal of their charges.

Once the charges have been dismissed, the This statute goes into effect 120 days from September 9th and will apply to eligible cases occurring on or after this date.individual will need to wait six months to apply for an expungement of the record of their arrest. However, if the individual is actually convicted of a disorderly or petty disorderly persons offense, they will need to wait five years from the date of completion of their sentence to expunge their record.

Individuals Not Eligible

Certain individuals are not eligible for conditional dismissal under the provisions of this program, including:

  • Individuals facing drug offenses, DWI (driving under the influence of drugs or alcohol) or domestic violence offenses.
  • Individuals who have had previously criminal charges dismissed pursuant to a diversionary program.
  • Individuals who have any previous criminal convictions; in other words they must be first time offenders.
