Although it may be common knowledge that a serious or violent indictable offense may lead to the deportation of an undocumented immigrant, it might not be immediately obvious to most that an individual who is pulled over and charged with a DUI in New Jersey may also be deported as a result of the report to the U.S. Immigration Customs Enforcement (ICE).
More specifically, former Attorney General of New Jersey wrote and circulated in a Directive in 2007 that law enforcement officers should inquire about a person’s immigration status under certain circumstances, including driving while intoxication. In other words, if an arrest is made in conjunction with a DUI, the arresting officer has a duty to inquire about the individual immigration status and possibly report it to ICE. Ultimately, a conviction could lead to the undocumented immigrant’s deportation.
Deportation Based on DUIs Is On the Rise
According to recent statistics, deportations due to DUIs in New Jersey are significantly on the rise. For instance, in 2010 more than 393,000 undocumented immigrant cases were reported to ICE. Of the reported cases, approximately 27,635 individuals were ultimately deported from the country.
