Saving Your Driver’s License from Suspension
We previously provided you with some reasons your license could be suspended. You may already realize that it’s not just about moving violations. Your license can be suspended for missing child support payments or ignoring parking tickets.
Can you avoid having your license suspended before it happens? In certain circumstances, yes. Let’s go through some scenarios:
- License Due to be Suspended for Accumulation of Points: Drivers who accumulate between 12-14 points within two years could find themselves in jeopardy of temporarily losing their licenses. How do they avoid it?
The State of New Jersey’s Motor Vehicle Commission suggests that drivers faced with license suspension for point accumulation take a class in lieu of the recommended thirty day suspension. Driver Improvement Programs are offered throughout the state and offered in a classroom setting. Completion of the program allows for removal of three points from the license of the driver facing suspension.
- Uninsured Motorist Suspension: Drivers who have received a Notice of a Suspension for failing to properly insure your car may be able to avoid the suspension. NJSA 39:6B-1 sets forth the liability insurance requirements for motor vehicles owned and operated in the state.
You can avoid a license suspension for failure to have insurance in one of two ways. You must either prove that you do have insurance. Or, you must provide information showing that you no longer own or use the vehicle.
These are just two examples of avoiding a license suspension before it goes into effect. Unfortunately, failure to appear in court for some violations cannot only result in license suspension. It can also mean that the court orders an arrest warrant. Or, that fines and other penalties are added as a consequence.
A license suspension for any cause can be costly. According to the law, the first time the suspension is placed on the record, the driver will be fined $500. For the second offense, the fine goes up to $750. The judge may also order incarceration for a second time license suspension.
