The 3 Myths of Red Light Camera Tickets

Twenty-one (21) states, including New Jersey, have enacted laws permitting some form of red light camera use. New Jersey is also one of 24 states that has red light cameras currently operating in at least one location.Traffic intersection signal surveillance camera with sunset sky.

New Jersey has enacted a statute for red light cameras under N.J.S.A. 39:4-8.15 to hold motorists liable if an advanced video/computer technology camera detects that they ran a red light after the traffic signal turned red. The camera captures two images of an alleged violation taken from the rear of the vehicle.

The 3 Myths

Getting a red light camera ticket does not mean that you are automatically guilty and should pay the ticket. Paying the violation and admitting fault is exactly what the state wants you to do since the major goal of these devices is to bring in revenue.

Below are three myths about red light tickets that are not true:

  1. There is a photograph of you running the light therefore you are guilty.
  2. You shouldn’t bother paying or fighting your red light ticket because it will not appear on your driving record.
  3. You are guilty because you didn’t make a complete stop before making a right turn.

Each of these myths are just that, a myth and not true. Most people think that a red light ticket cannot be dismissed. On the contrary, there are numerous defenses an experienced New Jersey red light camera ticket attorney can help you assert to successfully fight your ticket. Moreover, a red light camera ticket, similar to any other moving violation, can have negative consequences if not dismissed. It can result in heavy fines, points on your driving record, and an increase in your insurance premium.

The last myth is a little tricky because you are allowed to make a right turn without coming to a complete stop, as long as it is reasonable and prudent. However, the problem becomes arguing whether it was in fact reasonable and prudent to make the turn without stopping. Again, an experienced attorney can help strategize a defense to successfully fight a ticketing involving a right turn.
