New Jersey Municipal Court Cases
If someone discounts your case as just a municipal court offense, do not listen to them. Municipal court judges have a great deal of power. They can assess court fees, fines, and even order jail time. Municipal judges can revoke licenses or sentence defendants to community service. Granted municipal judge cannot order you to pay money damages to another party, but they do command authority. It may be foolish to go to municipal court without retaining the services of a qualified attorney.
The New Jersey State Judiciary provides information concerning the different courts in New Jersey. Municipal court judges are appointed by the town or city’s governing body. They serve at least three-year terms. Depending on the size of the community, there may be one judge or multiple judges. Court may be open only one day or evening a week. Alternatively, cases may be heard throughout the week.
What types of cases are heard in municipal court? The list is varied, but this is a basic outline:
• Traffic violations (including DUI cases where there is no personal injury or fatalities)
• Harassment cases (these can include citizen complaints)
• Disorderly persons offenses (minor drug offenses fall under this category)
• Simple assault
• Violation of fishing and gaming laws
• Failure to obey certain municipal codes, such as liquor licenses and building codes
• Trespassing cases
• Shoplifting matters
In some counties, such as Union County, certain municipal cases are initially referred to community dispute mediation. Although matters may be resolved using this process, it is not imperative that the parties come to an agreement. The case is then brought before the judge for final disposition.
For some, the advantage of taking an attorney to municipal court is one of expediency. Parties represented by a lawyer are heard first as a matter of courtesy.
