Consequences of Underage Drinking In New Jersey
New Jersey has a zero tolerance law with regard to underage drinking. This means that if the driver was under 21 years of age, the prosecution does not have to provide proof that the driver was actually intoxicated or that their blood alcohol content (BAC) was over 0.08%. Underage drinking accompanies serious consequences for young people and any adults who provide alcohol to individuals under the age of 21.
This article discusses the four serious consequences of underage drinking under New Jersey law.
- Monetary penalties. A DWI conviction for underage drinking can cost the young individual at least $500 in penalties.
- Loss of driving privileges. Underage individuals convicted of a DWI can have their driving privileges suspended or postponed 30 to 90 days.
- Community service. An underage DWI conviction can also result in the defendant having to serve 15 to 30 days of community service.
- Participation in education programs. Young individuals convicted of a DWI may also be mandated to participate in an alcohol and traffic safety education program.
If an underage driver commits a violation of more serious “adult” laws, the individual will be subject to the consequences of the more serious laws.

While underage drivers are subject to a different law with zero tolerance provisions in New Jersey, they are nevertheless still entitled to the same rights as other older drivers.
